Terms of Service — Mahalo Media

These Terms of Service ("Terms") govern your access to and use of the Mahalo Media digital reading application, the books.mahalopower.com website, and any related services (collectively, the "Service") provided by Mahalo Power LLC ("Company," "we," "us," or "our"). By creating an account, purchasing content, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to create an account and make purchases. By agreeing to these Terms, you represent and warrant that you are 18 years of age or older. If you are purchasing content for use by a minor, you are responsible for supervising that minor's use of the Service and for ensuring compliance with these Terms.

2. Account Registration

To purchase and access digital content, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@mahalopower.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used for fraudulent purposes.

3. Digital Content Purchases

All purchases made through books.mahalopower.com are for digital content licenses, not physical goods. When you purchase a book, you are granted a limited, non-exclusive, non-transferable license to access and read that content through the Mahalo Media application for personal, non-commercial use.

All prices are displayed in United States Dollars (USD) and are inclusive of applicable taxes where required by law. We reserve the right to change pricing at any time; price changes will not affect purchases already completed.

Payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's terms of service and authorize us to charge your selected payment method for the amount due.

4. License to Digital Content

Subject to your compliance with these Terms and payment of applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use purchased digital content solely through the Mahalo Media application. This license does not include:

The right to copy, reproduce, distribute, or publicly display any content
The right to modify, adapt, translate, or create derivative works
The right to transfer, sublicense, sell, or otherwise convey your access to any third party
Any use of content for commercial purposes

All digital content available through the Service is protected by copyright and other intellectual property laws. Unauthorized reproduction or distribution of any content constitutes a violation of applicable law and these Terms.

5. Content Protection

The Service employs technical measures to protect digital content, including device-bound encryption of downloaded assets. You agree not to circumvent, disable, or otherwise interfere with any content protection measures. Attempting to extract, copy, or redistribute protected content by any means is a violation of these Terms and may constitute a violation of applicable law, including the Digital Millennium Copyright Act (DMCA).

You acknowledge that purchased content is watermarked with account-identifying information for the purpose of deterring and identifying unauthorized redistribution.

6. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation
Attempt to gain unauthorized access to any part of the Service or its underlying systems
Use automated means to access or scrape the Service without our written consent
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Transmit any content that is defamatory, obscene, or otherwise objectionable
Interfere with the operation of the Service or the servers or networks supporting it
Attempt to reverse-engineer, decompile, or disassemble any portion of the Mahalo Media application

7. Availability and Offline Access

The Mahalo Media application allows downloaded books to be read offline for a period determined at the time of purchase. Your continued access to downloaded content requires periodic re-authentication with our servers to verify your account remains in good standing. If your account is suspended or terminated, offline access will be revoked at your next connection to the Service.

We do not guarantee uninterrupted availability of the Service and are not liable for any service interruption, downtime, or data loss.

8. Refunds

Please review our Refund Policy for complete information regarding refund eligibility. All sales are generally final. Refund requests are evaluated pursuant to the terms set forth in the Refund Policy.

9. Intellectual Property

All content available through the Service, including illustrations, text, audio narration, character designs, and book covers, is the intellectual property of the respective authors and rights holders and is licensed to us for distribution through the Service. The Mahalo Media application, its design, source code, and all associated materials are the intellectual property of Mahalo Power LLC. Nothing in these Terms transfers any intellectual property rights to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAHALO POWER LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Graham County, Arizona, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page and, where appropriate, by sending notice to the email address associated with your account. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
